The Landlord and Tenant Act 1985 is, amongst other things, very significant to leaseholders in England and Wales. Sections 18 - 30 form the basis of the legal rights and responsibilities of English and Welsh leaseholders in respect of variable residential service charges. Fully understanding sections 18 -30 of the Act is critical in understanding the rules concerning variable residential service charges in England and Wales. The wording of the Landlord and Tenant Act 1985 has been altered by successive Acts of Parliament. Most significantly the Landlord and Tenant Act 1987 and the Commonhold and Leasehold Reform Act 2002. Anyone reading the Landlord and Tenant Act needs to be very careful to ensure that they read the version which is currently in force (see link below).
